Yes. Electronic employment contracts are legally binding under the Electronic Transactions Act 1999 (Cth), provided the employee consented to electronic communication, the signatory can be identified, and the method is reliable. Zignature satisfies all requirements.
The 11 NES minimum entitlements are: maximum weekly hours, flexible working requests, parental leave, annual leave, personal/carer's leave, compassionate leave, unpaid family/domestic violence leave, community service leave, long service leave, public holidays, notice of termination and redundancy pay.
The Fair Work Act requires employers to give casual employees a Casual Employment Information Statement (CEIS). While a written contract isn't legally required, it is strongly recommended — especially given casual conversion rights introduced in 2021.
The FWIS is a mandatory document all new employees must receive from their employer at the start of employment. It can be provided electronically. Zignature's onboarding package includes a FWIS acknowledgement — evidence of receipt for Fair Work compliance.
Yes. Zignature's digital signing works across all Australian states and territories. ETA 1999 and state equivalents ensure e-signed contracts are legally valid wherever the employee is located.
Zignature's audit trail provides evidence of: when the FWIS was provided, when the contract was signed, and the exact contract terms at signing — all relevant to Fair Work Commission proceedings and underpayment investigations.
